Apple is Shooting Next iPhone 5 Ads???
At the end of May, rumor had it that Cupertino was looking for actors for an ad campaign starring the next-generation iPhone. On the same note, Apple has reportedly begun production of ad spots for a national advertising campaign around the next phone.
According to sources familiar with the matter, Apple is shooting the TV ads in Los Angeles, together with the ad agency TBWAChiatDay behind other Apple ads. According to another source cited by Appleinsider, the wrap up of the ads is projected around the first week of October. We've already heard October launch rumors and we've also heard people talking about a September launch with an October availability. Whether these rumors will turn out to be spot on or just, rumors, we'll find out in around a month's time.

In the not so cool section we go through two different segments of lawsuits. Apple vs. Samsung and how unethical things have gotten, and also HTC vs. Apple and how they're setting themselves out to beat Apple on this one.

iOS 5 beta 6 works with existing jailbreak tools
Seeing as Apple seeded iOS 5 beta 6 today, a lot of users want to know if they’ll need to wait in order to update and re-jailbreak. The answer to that is no. Go ahead and update. The existing version of Redsn0w for Mac and Sn0wbreeze for Windows will work just fine. I’ve confirmed this working on a 4th generation iPod Touch. iDB has confirmed it working as well.
The process should be the same as previous versions of Redsn0w and Sn0wbreeze. Just use the new beta 6 firmware file in place of beta 5 or earlier.
As always, remember that not only is iOS 5 in beta, these jailbreak tools are also beta. Unless you’re a developer or jailbreak developer, I’d probably hold off on doing this. Not all regular apps are compatible with iOS 5 let alone jailbreak apps. So be advised to proceed at your own risk.

Is iOS 5 getting better iTunes and App Store download management?
iTunes has also been improving over the last couple of betas. Now, if you buy an album, you can see the download progress of each track right in the list.
I’m so happy, I might even update when it’s finally released!
UPDATE: It seems to still throw you out if you’re in the main store, not if you’re in your previous purchases tab. Which is something, just not everything we wanted. Apple, make it happen!
UPDATE 2: Some of you are telling us you’re seeing this on iOS 4.3.x as well. iTunes and App Store pull their content from the web, so Apple can update them whenever they want without having to release new firmware. So, it’s possible some of this was or is being pushed out to everyone. Let us know what you’re seeing!
UPDATE 3: So sometimes it’s working and sometimes not. The App Store has been flaky the last two days so let’s wait and see how this pans out
iOS 5 likely coming first week of October Reports
iOS 5 will likely be launched in the first week of October. Apple traditionally releases a new version of iOS to the public alongside the release of new iPhone hardware, if not a couple of days before to help balance server loads. If iPhone 5 ends up being scheduled for October 7, then iOS 5 could be scheduled for any time that week up to and including the same Friday.

Apple wants to forbid the sale of all in Europe''Galaxy''
After having tried to block sales of the Galaxy Tab 10.1 in Germany and in most of Europe, Apple would be presented to the tribunal in The Hague a new request , much wider, to ban the sale of other devices in the series Galaxy of Samsung including Galaxy Ace Galaxy D Galaxy D Galaxy II and Tab 7 . Also mentioned other devices in the series for which "is expected to violate one or more of the patent rights claimed."
The prohibition of storage, importation, distribution, marketing would be required to Samsung Korea and all of its Dutch subsidiaries, including Samsung Logistics BV and Samsung Overseas BV , companies that play a crucial role in the distribution of Samsung products throughout Europe. According to the complaint of Apple, " Samsung Logistics is responsible for 28 distribution channels throughout Europe. "
Apple has it that Samsung and its subsidiaries to send a "request letter" to all their European customers to retrieve products from warehouse all under indictment "within 14 days "and to offer them compensation for the purchase price and transport costs . If customers do not comply with the request will also accused Apple of breach of intellectual property rights.
The Hague court will decide by September 15.

Apple takes battle with Android to the next level
Apple is one of the most powerful tech firms on the market right now. For a moment, it was the most valuable company in the USA (surpassing Exxon Mobil) but its recent assault on its major rival makes it look increasingly weak. Over the past few months, Apple has filed lawsuits against Samsung, HTC, Motorola and other Android users, accusing them of violating Apple’s patents. The targets may be varied, but it ultimately boils down to Apple Vs Google. The archrivals have been targeting each other for a long time now, and are being forced to compete on each other’s turf. Apple’s onslaught may seem like a strategic move to cut out the opposition, but critics are saying it smacks of desperation.

Apple sued by HTC over three more patents
Here we go again. In a move that is hardly going to surprise anyone anymore, HTC has now decided to sue Apple over infringement of their patents and stop the import and sales of the Macintosh, iOS and other devices in the US. This move comes just a day after Google’s purchase of Motorola Mobility for a staggering $12.5 billion in cash
HTC has claimed that Apple has infringed three of their patents, two of which HTC had purchased recently and third being their own creation. The patents are mostly regarding wireless technologies. HTC is seeking compensatory damages as well as triple damages for willful infringement.
Regardless of who is right or wrong here, we must say we are pretty tired of seeing companies battle each other in courtrooms instead of the market these days. Now the last thing we want to hear Apple, HTC or Samsung pushing back the launch of their next great phone because they were too busy suing each other.

Apple Will Launch The iPhone 5 In October
AllThingsD's own Kara Swisher has just come on record to confirm that the earlier reports of the iPhone 5 being launched on September 7th are wrong. All her sources, who even backed up John Paczkowski's earlier report, all point to an October release.
Kara even goes further to specify some of the specs we'll definitely get with this next generation release. We all know the A5 dual core processor and a higher resolution 8 megapixel camera are both certainties in this mix, but she also mentions that it'll bring the Qualcomm dual mode GSM/CDMA baseband chip that will allow the device to work on both the AT&T and Verizon networks. I'm not sure if I'd hold my breath on that one, since the iPad 2 is a current generation device, sporting a much larger case, and didn't include this dual mode GSM/CDMA chip, but time will tell.
With Apple holding their Fall Music Events in September at least for the past 5 years, we could assume that both reports are true. We could most likely have Apple announce the new iPhone on some day within September, which could include the 7th day, and have sales begin early October. We've known WSJ's Yukari Iwatani Kane for being Apple's person of choice when it comes to leaking important things they want people to know, so lets hope they end all the speculation by giving her a call soon.

iPhone 5 in hand
The picture shows athinner devices, Withrounded cornersand apparently bent on the back which you can see probably the Apple logo. Enlarging the picture would seem also that the camera flash poseteriore is longer, possibly twice, and placed below the sensor (Fig. 2). Unlikely to be aiPhone 3GS given the thickness but it would seem too "rounded" to be a iPhone4. Who took the photo is sure that it is a new product. But, honestly, many doubts remain.
Approaching the official launch, Apple may have decided to test the new devices to its employees outside ofCupertino campusbut after the experience I had with last year 'siPhone4would seem unlikely. We also remind you that 'iPhone 4 "Rediscovered"before the official launch was still locked up in a cover that masked design.

Apple won its Samsung Galaxy Tab 10.1 European ban based on a design sketch filed in 2004
Turns out we shouldn't have been so cruel to the US patent system that allows big business to trademark every button and icon it produces as if they are a sight unseen, and then sue the pants off other companies.
Apple won an injunction and selling ban against the Samsung Galaxy Tab 10.1 in a German court not based on a patent it holds in Europe, but on something called Community Design. The system has been created in the European Union in 2002, and basically allows for anyone to pay and patent not just photos of actual stuff, but also vague design sketches of products, software or packaging.
Once declared valid, these Community Designs are used in a legal system which allows it, like the German one, to win injunctions against the competition, and the court is obliged to grant the motion if the paperwork is correct, without even notifying the defendant, and its decision is valid throughout the EU. In this case, however, Samsung had known about the upcoming filing, despite that it acted surprised, and has even filed a protective pleading July 29, before Apple brought the case to court, but it hasn't been considered stronger than Cupertino's claims.
The real kicker is that Apple has followed in Microsoft's footsteps, and has filed a number of those vague sketched of iPods, Macs, iPhones, tablets and so on, with various shapes, forms and button placements, with the Community Design body, and it can now use them to obtain injunctions. The court doesn't even have to understand what is going on, they just see a shape resembling the Galaxy Tab 10.1, and grant the injunction, as long as the Community Design has been given to Apple and paid for. No review, no prior art resemblance like with the USPTO.
To add insult to injury, Apple's motion is based on Community Design 003781832 - not only does it look like a napkin sketch, but it has also been filed in 2004, six years before Apple's first tablet saw the light of day. Basically it seems that Apple has been sifting through its numerous Community Design drawings to find something that resembles most the rectangular shape and tapered edges of the Galaxy Tab 10.1, knowing that the court is obliged to grant the injunction against that.
Now Samsung will fight the claims August 25, plus some big retailers have said they don't plan to stop selling the Galaxy Tab 10.1 batches they have, and they also sell Apple gear, so they might get their way. Still, it is guilty until proven innocent, and despite that we know this is a regular way to do business for big companies, what happens if you are a small start-up and try to come up with something fairly novel, only to have a legal army banning your product based on hot air. Below are some examples of the sketches Apple has filed for the iPhone, for instance.
